Terms & Conditions

This document, together with the documents referred to in it, sets out the terms and conditions on which we provide the services or information listed on our website. By using the services available on our site, you agree to be bound by these terms.

1 Information About Us

www.Sunegypt.com is a travel directory site operated by Sun International For Tourism, registered in Egypt under company number 8024 with a registered office at 26 Attia El Sawalhy, 8th District, Naser City, Cairo.

In these terms and conditions, “you” and “your” means all persons named on your booking, including anyone who is added or substituted at a later date, as the context requires. “We”, “us” and “our” means Sunegypt.com.

2 Your Status

  • You must be at least 18 years old at the time the booking is made.
  • You agree to abide by the terms or conditions of purchase imposed by the supplier responsible for your booking, including payment of all amounts when due and compliance with all rules and restrictions regarding availability and use of fares, products or services.
  • Any violation of a supplier’s conditions may result in cancellation of reservations or purchases, denial of access to flights, hotels or automobiles, and forfeiture of monies paid.
  • You are completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of this site, including fares or the cost of services provided by suppliers contracted through this website.

3 Our Status

We operate as an intermediary between you and the third-party suppliers featured or linked to on our website. Any resulting legal contract in respect of any bookings made through our website is between you and the third-party supplier concerned and is subject to the terms and conditions of that third-party supplier.

You should carefully review the supplier’s terms and conditions before entering into a contract with them. These are available from us on request.

We cannot give any undertaking that products purchased from third-party sellers or companies to whose website we provide a link will be of satisfactory quality, and such warranties are disclaimed by us. This disclaimer does not affect your statutory rights against the third-party supplier.


4 Travel Destinations Risks

Although most travel is completed without incident, travel to certain destinations may involve greater risk than others. We urge passengers to review travel prohibitions, warnings, announcements and advisories issued by the Foreign and Commonwealth Office Travel Advice Unit before booking travel.

Information on conditions in various countries and the level of risk associated with travel can be found at gov.uk/browse/abroad.

It is your responsibility to ensure you are aware of all recommended vaccinations and health precautions in good time before departure. Details are available from your GP surgery, the National Travel Health Network and Centre at travelhealthpro.org.uk, and NHS travel health resources at nhs.uk.

For holidays in the EU/EEA, travellers should obtain an EHIC before departure. An EHIC is not a substitute for travel insurance. Vaccination and health requirements may change at any time, so you should check with a doctor or clinic not less than six weeks before departure.

By offering travel to particular destinations, we do not represent or warrant that travel to such points is advisable or without risk, and we are not liable for damages or losses resulting from travel to such destinations.

5 Information and Suitability

The content of our pages was compiled with utmost diligence. However, we cannot guarantee that the data is correct, complete or up-to-date. Information, products, and services published on this website may include inaccuracies or typographical errors.

In particular, Sunegypt.com and its affiliates do not guarantee the accuracy of information and descriptions relating to accommodation, air, cruise, car, attractions and other travel products displayed on this website, including photographs, hotel amenities, and general product descriptions, much of which is provided by respective suppliers.

Any accommodation rating displayed on this website is intended only as a general guideline, and Sunegypt.com does not guarantee the accuracy of the rating. Changes are periodically added to the information herein, and Sunegypt.com, its affiliates and/or their respective suppliers may make improvements and/or changes to this website at any time.

We make no representations about the suitability of the information, products, and services contained on this website for any purpose, and the inclusion of any products or services on this website does not constitute any endorsement or recommendation by us.


6 Liability & Notices

Liability

We accept no liability for any contract you enter into or for any services or arrangements you purchase, or for the acts or omissions of any supplier or other party connected with such arrangements. For all arrangements, your contract will be with the supplier of the arrangements.

Our maximum liability to you, if we are found to have been at fault for any service we provide, is limited to the commission we have earned or are due to earn in respect of the booking in question. We do not exclude or limit liability for death or personal injury arising as a result of our negligence or that of our employees acting in the course of their employment.

Notices

All notices given by you to us must be sent to 26 Attia El Sawalhy, 8th District, Naser City, Cairo, Egypt. We may give notice to you at the e-mail or postal address you provide when registering, or in any of the ways specified in these terms.

Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter.

Right to Vary These Terms

We have the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms in force at the time you make use of the services provided by us unless changes are required by law or governmental authority.

Law and Jurisdiction

Use of any of the services provided through our site will be governed by Egyptian Law. Any dispute arising from, or related to, the use of such services or any contract between you and us shall be subject to the exclusive jurisdiction of the courts of England and Wales.


7 Website Use Terms

Prohibited Uses

  • You may use our site only for lawful purposes and not in any way that breaches applicable local, national or international law or regulation.
  • You may not use our site in any unlawful or fraudulent way, or for any unlawful or fraudulent purpose or effect.
  • You may not harm or attempt to harm minors, send spam, or knowingly transmit viruses, trojans, worms, spyware or other harmful material.
  • You agree not to reproduce, duplicate, copy or re-sell any part of our site and not to access, interfere with, damage or disrupt any part of our site or related systems without authority.

Content Standards

These standards apply to any material you contribute to our site. Contributions must be accurate where they state facts, genuinely held where they state opinions, and comply with applicable law.

  • Contributions must not be defamatory, obscene, offensive, hateful or inflammatory.
  • They must not promote sexually explicit material, violence, discrimination, illegal activity, or unlawful acts.
  • They must not infringe copyright, database rights or trade marks, deceive people, breach legal duties, invade privacy, or impersonate others.

Suspension and Termination

We will determine, at our discretion, whether there has been a breach of the content standards. Failure to comply may result in temporary or permanent withdrawal of your right to use our site, removal of material, warnings, legal proceedings, further legal action, and disclosure to law enforcement authorities where reasonably necessary.

Terms of Website Use

By using our site, whether as a guest or a registered user, you indicate that you accept these terms of use and agree to abide by them. If you do not agree, you should refrain from using the site immediately.

Accessing Our Site

Access to our site is permitted temporarily, and we reserve the right to withdraw or amend the service we provide without notice. We may restrict access to some or all parts of the site from time to time.

If you are provided with a user identification code, password or other security information, you must treat it as confidential and must not disclose it to any third party.

Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our site and in the material published on it. You may print one copy or download extracts for personal reference, but you must not modify or use materials for commercial purposes without a licence from us or our licensors.

Reliance on Information Posted

Commentaries and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We disclaim all liability and responsibility arising from any reliance placed on such materials.

Our Site Changes Regularly

We update our site regularly and may change the content at any time. If the need arises, we may suspend access to our site or close it indefinitely. Material on our site may be out of date at any given time, and we are under no obligation to update it.

Our Liability

The material displayed on our site is provided without guarantees, conditions or warranties as to accuracy. To the extent permitted by law, we exclude all conditions, warranties and other terms implied by statute, common law or the law of equity, as well as liability for direct, indirect or consequential loss or damage arising in connection with use of our site.

Information About You

We process information about you in accordance with our data protection policy. By using our site, you consent to such processing and warrant that all data provided by you is accurate.

Transactions Through Our Site

Contracts for the supply of services or information formed through our site are governed by our terms and conditions of supply.

Uploading Material

Any material you upload to our site will be considered non-confidential and non-proprietary, and we may use, copy, distribute and disclose it to third parties for any purpose. We may also disclose your identity to any third party claiming that your material violates their intellectual property rights or privacy.

Viruses, Hacking and Other Offences

You must not misuse our site by knowingly introducing viruses or other harmful material, attempting unauthorised access, or attacking the site by denial-of-service or distributed denial-of-service attack. We will report breaches to law enforcement authorities and cooperate with them by disclosing your identity where required.


8 Package Holiday Booking Conditions

1. Your Holiday Contract

When you make a booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract exists as soon as we issue our confirmation invoice. This contract is governed by Egyptian Law and the jurisdiction of the English Courts, though you may choose the law and jurisdiction of Scotland or Northern Ireland if you live there and wish to do so.

2. Your Holiday Price

  • We reserve the right to alter the prices of holidays shown in our brochures or website. You will be advised of the current price before your contract is confirmed.
  • When you make your booking, you must pay a deposit of 100% of the holiday cost per person. The balance must be paid at least 4 weeks before departure.
  • If the deposit and/or balance is not paid in time, we may cancel your travel arrangements and retain your deposit.
  • The price of your travel arrangements is fully guaranteed and will not be subject to surcharges.

3. If You Change Your Booking

If you wish to change your travel arrangements after our confirmation invoice has been issued, we will do our utmost to make the changes, but this may not always be possible. Requests must be made in writing by the person who made the booking or your travel agent.

You will be asked to pay an administration charge of £25 per booking, plus any further cost we incur. Certain travel arrangements may not be changeable after reservation and may incur cancellation charges of up to 100% of that part of the arrangements.

4. If You Cancel Your Holiday

You, or any member of your party, may cancel your travel arrangements at any time by written notification. Since we incur costs in cancelling your travel arrangements, cancellation charges apply:

  • 0–2 days before departure: 100% of accommodation and/or excursion costs. Airline tickets are non-refundable and non-amendable.
  • More than 2 days before departure: £35 administration fee deducted from any accommodation and/or excursion amount paid to us. Airline tickets remain non-refundable and non-amendable.

If the reason for your cancellation is covered by your insurance policy, you may be able to reclaim these charges.

5. If We Change or Cancel Your Holiday

We may occasionally have to make changes to or cancel your booking and reserve the right to do so at any time. If we make a major change, we will inform you or your travel agent as soon as reasonably possible and you may choose to accept the change, accept alternative arrangements if available, or cancel and receive a full refund.

We will not cancel your travel arrangements less than 8 weeks before departure except for force majeure or failure to pay the final balance. In some cases, we will also pay compensation depending on how close to departure the change or cancellation occurs.

Compensation Guide: More than 43 days: £Nil. 42–29 days: £40. 28–15 days: £50. 0–14 days: £70.

6. Force Majeure

We will not pay compensation if we have to cancel or change your travel arrangements because of unusual or unforeseeable circumstances beyond our control, including war, riots, industrial disputes, terrorist activity, natural or nuclear disasters, fire, adverse weather, epidemics, pandemics, or unavoidable technical problems with transport.


9 Complaints, Travel Requirements & Contact

If You Have a Complaint

If you have a problem during your holiday, please inform the relevant supplier and our resort representative immediately so they can try to put things right. If your complaint is not resolved locally, you should write to our Customer Services Department within 28 days of your return, giving your booking reference and all relevant information.

Our Liability to You

If the contract we have with you is not performed or is improperly performed by us or our suppliers, we will pay appropriate compensation if this has affected the enjoyment of your travel arrangements, subject to the limitations and conventions set out in the full terms. Our liability, except in cases involving death, injury or illness, is limited to a maximum of one times the cost of your travel arrangements.

Prompt Assistance in the Resort

Where appropriate, we will offer prompt assistance if the contract is not performed or is improperly performed as a result of failures attributable to a third party, unusual and unforeseeable circumstances, or events which we or our suppliers could not foresee or forestall.

Passports, Visas and Health

Passport, visa and immigration requirements are your responsibility, and you should confirm these with the relevant embassies and/or consulates. Neither we nor our suppliers accept responsibility if you cannot travel because you have not complied with these requirements.

Accommodation providers may apply nationality or residency restrictions to special rates. If you think this may affect your booking, please contact our Customer Service team before departure.

Excursions

Excursions or tours booked or paid for while you are on holiday are not part of your package holiday provided by us. For any such excursion or tour, your contract will be with the operator and not with us, and we are not responsible for anything that happens during its provision.
